Who are we?
Drummer is operated by Drummer BV (in formation), Generaal Lemanstraat 33 bus 201, 2018 Antwerpen, Belgium (“Drummer”, “we”, “us”). You reach us at hello@drummerhq.com.
When do these terms apply?
These terms govern the use of the Drummer web app at app.drummerhq.com and the Drummer phone apps for iOS and Android (together, “the service”). They apply to the organisation that subscribes to Drummer (“the customer”) and to every person the customer gives access (“users”). By using the service, you accept these terms.
A signed customer agreement or order form always overrides these terms where they differ. Our privacy policy and the data processing agreement (“DPA”) we sign with each customer describe how we handle personal data.
Drummer is a service for businesses. It is not offered to consumers.
How do accounts work?
Each user has a personal account, opened with a work email address. Users sign in with a one-time code sent by email, or with Google. Accounts are personal: you do not share them or your sign-in codes with anyone.
The customer decides who gets access and with which role, and removes access for people who leave. You tell us at hello@drummerhq.com as soon as you suspect that someone else uses your account.
What may you not do?
You use the service only for the customer’s lawful business purposes. You do not:
- record a conversation without the notice and legal basis the law requires;
- upload unlawful content, malicious code or data you have no right to process;
- try to gain unauthorised access to the service, other workspaces or our systems, or test their security without our written permission;
- disrupt or overload the service, or circumvent its limits or security measures;
- copy, resell or sublicense the service, or reverse-engineer it except where the law allows it;
- use the service or its output to build a competing product.
Who owns the data in your workspace?
Everything the customer brings into its workspace stays the customer’s: recordings, transcripts, scores, comments, CRM data and contacts. We process it only to provide the service, on the customer’s instructions and under the DPA. We never use it to train AI models, ours or a provider’s.
The customer is the controller of that data. It informs the people it records, including its own staff and, where one exists, its works council, and it has a legal basis for recording and scoring them.
How do you treat AI output?
Transcripts, scores, summaries, follow-up drafts, CRM updates and other output that Drummer’s AI writes are drafts. A person checks them before they reach a customer or the CRM. AI output can contain errors, and the customer decides what it does with it.
Scores support coaching. The customer does not use them as the sole basis for a decision with legal or similarly significant effect on a person.
Which other services can you connect?
The customer can connect Google, Microsoft, HubSpot, Salesforce, Microsoft Dynamics 365, Teamleader and other services. The customer chooses them and holds its own agreement with each provider. That provider’s terms apply to the data held there. We are not responsible for their availability or for changes they make to their services.
Is the service always available, and can it change?
We work to keep the service available at all times and announce planned maintenance in advance. We do not promise uninterrupted or error-free operation, except where a signed customer agreement sets a service level.
We develop the service continuously and change features over time. A change that materially reduces what a customer pays for is announced to the customer’s administrators by email before it takes effect.
Who owns Drummer?
Drummer, its software, design, brand and documentation belong to us or our licensors. The customer receives a non-exclusive, non-transferable right to use the service for its own business during its subscription. No other right passes to you.
When you send us feedback, we may use it to improve the service without obligation to you.
What does the service cost?
Fees, billing period and payment terms are set in the customer’s order form. Fees exclude VAT. When an invoice remains unpaid 30 days after we have sent a reminder, we may suspend access until it is paid.
What is our liability?
Our total liability for all claims arising from the service in any 12-month period is limited to the fees the customer paid for the service in the 12 months before the event that caused the claim.
We are not liable for indirect or consequential loss, such as lost profit, lost revenue, lost business opportunities, damage to reputation or the cost of replacement services.
The cap and these exclusions never apply to fraud, intentional misconduct or gross negligence, or to any other liability that cannot be limited under Belgian law.
When can access be suspended or ended?
We may suspend a user or a workspace immediately when its use threatens the security or operation of the service or breaches these terms, and we tell the customer why. We restore access as soon as the cause is removed.
The subscription term and how to end it are set in the order form. Either party may end the agreement with immediate effect when the other party seriously breaches it and does not remedy the breach within 30 days of written notice.
When the agreement ends, access stops. Before the end date, the customer can ask us for a copy of its workspace data. We delete workspace data as described in our privacy policy.
What about the website?
You may browse drummerhq.com and share its pages. Its content is for information; prices, features and examples on the website do not bind us until they are in an order form. You do not copy the website’s content for commercial use without our permission.
Which law applies?
These terms are governed by Belgian law. The courts of Antwerp have exclusive jurisdiction over any dispute arising from them.
A complaint about how we handle personal data can also go to the Belgian Data Protection Authority, the Gegevensbeschermingsautoriteit, as our privacy policy describes.
How do we change these terms?
The date at the top of this page changes with every update. The administrators of every customer workspace receive an email 30 days before a material change takes effect. Changes never alter a signed customer agreement.
